      Warranty Terms

      WARRANTY

      GENERAL

      MK-dent's dealers, agents or employees are not permitted to modify, extend or add additional terms to the terms of this warranty.

      Should individual provisions of this guarantee be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

      This warranty is governed by the laws of the Federal Republic of Germany.

      WHAT IS COVERED BY THE WARRANTY?

      MK-dent GmbH guarantees that products bearing the MK-dent brand, accessories contained in the original packaging and accessories bearing the MK-dent brand are free from defects in materials and workmanship if they are used in accordance with MK-dent's instructions for use.

      The warranty can be found in the instructions for use of the product and is valid from the original date of purchase by the end user and buyer ("Warranty Period").

      Note: All claims made under mk-dent's limited warranty are subject to the terms and conditions set forth in this warranty document.

      WHAT IS NOT COVERED BY THE WARRANTY?

      Kindly note that only defects occurring from a manufacturing or material issue can be covered under warranty. If the issue results from insufficient maintenance or improper handling the repairs costs will need to be charged.

      If you are located in one of the following countires and purchased your product through a local dealer you are eligible for our additional FairCare warranty service:

      - Australia

      - Austria

      - Germany

      - Netherlands

      This warranty does not apply to: (a) wear parts such as ball bearings, gears, collets, o-rings that wear out over time, unless the defect is due to a defect in materials or workmanship; (b) superficial damage, including scratches, dents caused by physical and physical influences; (c) damage resulting from use with third-party components or products that do not comply with the technical specifications of the MK-dent product; (d) damage resulting from accidents, improper use, or other external causes; (e) damage resulting from the improper use or preparation of the MK-dent product in accordance with instructions for use, technical data or published guidelines; (f) damage resulting from service work not carried out by MK-dent or qualified service partners; (g) MK-dent products to which modifications have been made without the written consent of MK-dent; (h) defects caused by normal wear and tear or due to the normal aging of the MK-dent product; (i) MK-dent products whose serial number has been removed or altered.

      SPECIAL WARRANTY SERVICE – MK-DENT FAIRCARE WARRANTY

      With the FAIRCARE Warranty, your MK-dent product is fully protected and will be repaired free of charge by the MK-dent service. The repair service includes all wear any tear components such as bearings, o-rings etc. which are not covered by the regular warranty (industry standard).

      Please note that the FAIRCARE Warranty can only be provided by the MK-dent service and not by third parties.

      The warranty periods for each product can be found in the current user manual. Physical damage is also excluded here.

      HOW DOES MK-dent PROCEED IN THE EVENT OF A WARRANTY CLAIM?

      If you make a warranty claim against MK-dent under this warranty during the warranty period, MK-dent may, at its own discretion:

      (i) repair the MK-dent product with new parts or parts that correspond in performance and functionality to new parts, or

      (ii) replace the MK-dent Product with the same model (or, with your consent, with a similar Product) consisting of new and/or previously used parts as good as new in terms of performance and functionality, or

      (iii) refund the purchase price against return of the MK-dent product.

      If a product or part has been replaced or the purchase price has been refunded, the replacement item becomes your property and the item that has been replaced or for which the purchase price has been refunded becomes the property of MK-dent.

      Spare parts, replacement products or repaired MK-dent products are subject to the remaining warranty period for the original MK-dent product or receive a ninety (90) day warranty from the date of replacement or repair, whichever is more favorable to you.

      Special Notice

      The MK-dent warranty is a voluntary warranty of the manufacturer. It grants additional rights regardless of the rights granted by consumer protection laws. These statutory rights are not limited by the warranty.

      Thus, the services from the MK-dent warranty are intended as a supplement and not as a substitute for the rights granted by consumer protection laws.

      If a product is defective, consumers can in particular claim the rights under §§ 434 ff., §§ 474 ff. BGB of the Civil Code.

      Consumers can choose to claim the service under the MK-dent warranty limited to one year or in accordance with their statutory consumer protection rights.

      Important: The provisions of the MK-dent warranty do not apply to claims arising from statutory consumer protection rights.
